The U. S. government is considering a $1.6 billion settlement with a company to settle a lawsuit over alleged sexual performance problems related to a product that was allegedly marketed as a remedy for erectile dysfunction.
Department of Justice (DOJ) announced that it was considering the offer to resolve a class-action lawsuit filed by the Canadian International Property Group against a company that had been selling Viagra and other erectile dysfunction drugs, known as Cialis and Adcirca, in Canada, for $25 per tablet. The settlement resolves the matter’s allegations that Cialis and Adcirca contained undeclared ingredients. The settlement will be announced in a U. District Court in New York on June 7, 2016.
The settlement, announced by the Department of Justice, was based on information provided to the media in connection with the proposed settlement. The DOJ had filed the suit in the U. District Court for the Western District of Louisiana. The suit claimed that Cialis contained hidden ingredients, including sildenafil, a chemical used in prescription drugs, that can be sold in the U. as an over-the-counter treatment for erectile dysfunction.
The DOJ has also filed a complaint against the Canadian International Property Group and Cialis, the company that sold the erectile dysfunction drug Cialis in the United States.
In a written response to the DOJ’s request for comment on June 7, 2016, the company said, “The U. Department of Justice has concluded that Cialis is not a legitimate treatment for erectile dysfunction and the complaint does not meet the requirements of the Private Securities Litigation Reform Act.”
The DOJ said that Cialis was being sold at a wholesale price in the United States, with an initial price of $0.79 per tablet of Cialis. The drug was sold in Canada by a Canadian company and then sold to a company in the United States, as part of the settlement, under the brand name Cialis.
Cialis is also sold in Canada by a Canadian company, Cialis Canada Inc, as part of the settlement, and by a company that sold it as Adcirca, the brand name drug Cialis. It is the only drug currently available in the United States for treatment of erectile dysfunction.
A spokeswoman for CialisCanada Inc. said, “While we believe that our Canadian business is focused on providing affordable and effective treatment for erectile dysfunction, we are pleased to provide the opportunity for our Canadian customers to take advantage of this product and to share the cost savings they may have missed due to its generic name.”
The DOJ has also been accused of selling the drug in the United States without a valid prescription. A spokesman for CialisCanada Inc. said, “The company did not sell the product. The product was not approved by the Food and Drug Administration in Canada.”
The company said, “As of this writing, we do not have any information that could be used to identify the originator, or the manufacturer or distributor of the product.”
